Guest Liability Waiver: In consideration of being permitted to stay at the Property, the Guest(s) acknowledge and agree as follows: 1. Assumption of Risk Guest(s) understands and acknowledges that use of the Property, including stairs, appliances, furniture, decks, and/or outdoor areas, involves risks of injury. Guest(s) voluntarily assumes all risks associated with their stay inclusive but not limited to injury, illness, or property damage arising from their stay. 2. Release of Liability Guest(s), on behalf of themselves and their invitees, heirs, successors, and assigns, hereby release and discharge Don Properties, LLC, its owners, managers, and affiliates, and the Property owner from any and all claims, liabilities, damages, or causes of action for personal injury, death, or property damage arising out of or in connection with the use or occupancy of the Property. 3. Indemnification Guest(s) agree to indemnify, defend, and hold harmless Don Properties, LLC, its owners, managers, and affiliates, and the Property owner from and against any claims, damages, losses, or expenses (including attorney’s fees) arising from Guest’s use or occupancy of the Property; Guest’s actions or omissions of Guest’s invitees; and/or Guest’s violations of law, house rules, or this Agreement. 4. Property Condition Guest(s) accept the Property “as is” and agree to leave it in substantially the same condition upon departure. 5. Insurance Disclaimer Guest(s) understand that Owner’s/LLC’s insurance does not cover Guest’s personal property or accidents. Guest(s) are encouraged to carry their own travel or renter’s insurance. By booking and/or entering the Property, Guest(s) acknowledge that they have read, understood, and agreed to abide by these House Rules and the Liability Waiver.
